Welcome to BATIAD Consult Nigeria Limited (RC: 763B35). By engaging our maritime logistics, heavy lift operations, shipping support, and transportation services, you agree to abide by the terms and conditions outlined below. Please read them carefully as they govern your use of our professional services across Nigeria's maritime and logistics sectors.

Service Scope and Operations

  • Heavy Lift & Project Cargo: All lifting operations require systematic assessment including load test, lift plan, risk analysis, and job safety protocols. Clients must provide accurate cargo specifications including weight, dimensions, and center of gravity.
  • Dangerous Cargo Handling: Transportation of IMDG and IATA classified dangerous goods requires proper documentation, safety data sheets, and compliance with international maritime dangerous goods regulations.
  • Documentation Requirements: Accurate and complete shipping documentation, customs clearance papers, and certificates of origin must be provided by the client for all shipments.
  • Offshore Logistics: Offshore field support services are subject to weather conditions and offshore safety protocols. Schedules may be adjusted for operational safety.

Liability and Insurance

  • Limited Liability: BATIAD Consult is not liable for loss or damage caused by events beyond our control, including but not limited to natural disasters, port strikes, acts of terrorism, vessel delays, or force majeure events.
  • Insurance Coverage: Clients are responsible for securing comprehensive insurance coverage for their cargo unless explicitly agreed upon in writing. We recommend marine cargo insurance for all shipments.
  • Claims Procedure: All claims for loss, damage, or delay must be submitted in writing within 14 days of delivery or expected delivery date, accompanied by supporting documentation including bill of lading, commercial invoice, and photographic evidence where applicable.
  • Safety Standards: We maintain occupational safety, health, and environment protocols in all operations. Clients must comply with our safety requirements during cargo handover and operations.

Payment Terms

  • Payment Schedule: Payment terms are specified in individual service agreements and must be honored according to agreed schedules.
  • Currency: All payments are due in Nigerian Naira (NGN) unless otherwise agreed in writing.
  • Late Payments: Late payments may be subject to interest charges and may result in suspension of services until outstanding amounts are settled.

Cancellation and Changes

  • Cancellations: Service cancellations must be made in writing at least 48 hours before scheduled operations and may be subject to cancellation fees, particularly for heavy lift operations where specialized equipment has been mobilized.
  • Changes to Booking: Any modifications to confirmed bookings must be approved in writing and may incur additional charges, especially if equipment or vessel schedules have been committed.
  • Weather-Related Delays: For offshore operations, weather-related postponements will not incur additional charges, but clients will be responsible for standby costs if applicable.

Governing Law and Jurisdiction

These terms and conditions are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these terms or our services will be resolved in the courts of Lagos State, Nigeria, or through arbitration as mutually agreed upon by both parties.
